Rubbish Removal Camden Service Terms and Conditions

These Terms and Conditions govern the provision of rubbish removal and waste collection services by Rubbish Removal Camden to residential and commercial customers within our service area. By making a booking, confirming a quotation, or allowing our operatives to carry out any work, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, business, or organisation requesting services from Rubbish Removal Camden.

We, Us, Our means Rubbish Removal Camden, the service provider.

Services means the rubbish removal, waste collection, loading, transportation, clearance, and associated services provided by us.

Waste means any rubbish, refuse, junk, clutter, or other materials agreed to be removed as part of the Services, excluding any items that are prohibited under these Terms or applicable law.

Service Area means the geographic area in which we offer our rubbish removal and waste collection services, as advised by us from time to time.

2. Scope of Services

We provide rubbish removal and waste collection services, which may include domestic clearances, commercial clearances, garden waste removal, bulky item removal, and other related services as agreed in advance.

The exact scope of the Services to be provided will be set out in your booking confirmation or our written or verbal quotation. Any additional work requested on the day will be subject to our approval and may incur extra charges.

We reserve the right to decline to remove any items that are not compliant with applicable waste regulations, are unsafe to handle, or are outside the agreed scope of work.

3. Booking Process

Bookings can be made by telephone or other communication methods that we make available. When making a booking you will be asked to provide accurate details about:

1. The type and approximate volume or weight of waste you need collected.

2. The access conditions at the collection address, including stairs, parking, and any restrictions.

3. The preferred date and time window for the collection.

On the basis of the information you provide, we may give you an estimate or a quotation. All bookings are subject to availability and our confirmation.

We may confirm your booking by email, text message, or verbally, and will allocate a provisional or specific time slot. Time slots are indicative and not guaranteed, although we will use reasonable efforts to arrive within the agreed period.

You must ensure that someone over the age of 18 is present at the property at the time of collection to grant access, confirm the items to be removed, and authorise any changes to the Service or charges.

4. Estimates, Quotations and Pricing

Any estimate given before arrival is based on the information you provide and is not binding. The final price will be confirmed once our operatives have inspected the waste on site and assessed the volume, weight, and nature of the items.

Our prices may be based on one or a combination of factors, including but not limited to:

1. Volume of waste measured as a proportion of a vehicle load.

2. Weight of waste, where applicable.

3. Type of waste, including any surcharges for specific materials such as mattresses, fridges, electricals, or hazardous items that we are allowed to carry.

4. Labour time required for loading, access difficulty, or additional handling.

We will inform you of the final price before commencing work. If you do not agree to the revised price you may cancel the Service at that point without charge, provided that work has not begun and our operatives have not incurred additional costs specific to your visit, such as chargeable parking.

5. Payments and Invoicing

Payment is due in full on completion of the Services unless we have agreed alternative terms in writing in advance.

We accept the payment methods that we inform you about at the time of booking or collection. You agree to ensure that payment can be made promptly on completion of the job.

Where payment is not made on completion, and we have agreed to invoice you, payment will be due within the period stated on the invoice. If no period is stated, payment will be due within 7 days of the invoice date.

We reserve the right to charge interest on overdue sums at the statutory rate applicable in the United Kingdom and to recover from you any reasonable costs incurred in seeking to enforce payment.

6. Cancellations and Amendments

You may cancel or amend your booking by contacting us as early as possible.

For standard bookings, if you cancel or significantly amend the booking less than 24 hours before the agreed arrival time, we reserve the right to charge a cancellation fee to cover our administration and any travel or scheduling costs incurred.

If our operatives attend the collection address at the agreed time but are unable to gain access, or you are not present to authorise the work, we may treat this as a late cancellation and charge a call-out or cancellation fee.

Any changes to the volume, type, or location of the waste may result in a revised quotation. If you do not accept the revised quotation you may cancel the Service without further cost, provided that our operatives have not yet started loading and no additional expenses have been incurred specifically for your job.

7. Customer Obligations

You agree to:

1. Provide accurate information about the waste and access conditions at the time of booking.

2. Ensure safe and reasonable access to the items to be removed.

3. Secure any necessary parking permissions or permits where required.

4. Ensure that items to be removed are clearly identified and, where possible, gathered in one accessible area.

5. Not present any items that are prohibited or hazardous in a manner inconsistent with applicable regulations or these Terms.

If safe access is not available, or if the condition of the site presents a health and safety risk that we consider unacceptable, we may refuse to carry out all or part of the Services and may charge a cancellation fee.

8. Waste Regulations and Prohibited Items

We operate in compliance with applicable UK waste management legislation and regulations. We act as a waste carrier and will dispose of collected materials at licensed facilities or through approved recycling and recovery routes.

We will not knowingly collect or transport any waste that is illegal, hazardous, or subject to special handling requirements that we are not authorised or equipped to deal with. This may include, but is not limited to:

1. Asbestos or materials suspected of containing asbestos.

2. Clinical or medical waste.

3. Corrosive, flammable, explosive, or toxic substances.

4. Gas bottles that we are not authorised to carry.

5. Chemicals, oils, solvents, or paints unless expressly agreed by us in advance.

If such items are discovered during the collection, we may refuse to remove them and may charge you for any additional time or costs incurred. You remain responsible for identifying and disclosing any such items in advance.

9. Service Delivery, Access and Parking

We will use reasonable care and skill in providing the Services and will make reasonable efforts to arrive within the agreed time frame. However, timings are estimates only and may be affected by traffic, weather, or other factors beyond our control.

You are responsible for ensuring that suitable parking is available close to the collection address. Any parking charges or penalties incurred directly as a result of carrying out the Service may be added to your final bill.

Our operatives will carry out the loading of waste, subject to safe access. We may decline to carry items from locations that we reasonably consider unsafe, structurally unsound, or likely to cause injury or damage.

10. Damage and Liability

We will take reasonable care when carrying out the Services. However, you acknowledge that movement of large or heavy items, especially in confined spaces, carries some risk of minor damage such as scuffs or marks to walls, floors, or door frames.

You should take reasonable steps to protect floors, walls, and fixtures if you are concerned about potential cosmetic damage.

Our liability for any loss or damage arising from the Services is limited as follows:

1. We will not be liable for any loss or damage that is not a foreseeable result of our breach of these Terms or our negligence.

2. We will not be liable for any indirect, consequential, or economic loss, including loss of profit, business, or opportunity.

3. Our total liability to you in respect of any claim arising out of or in connection with the Services shall not exceed the total price paid or payable for the specific job giving rise to the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.

11. Ownership of Items and Disposal

By presenting items for removal and authorising us to take them away, you confirm that you have the right to dispose of those items and that they are free from third party claims.

Once we have removed the items, they become our property and we may reuse, recycle, resell, donate, or dispose of them at our discretion, subject to compliance with applicable regulations.

12. Complaints and Disputes

If you have any concerns or complaints about our rubbish removal services, you should notify us as soon as possible so that we have the opportunity to address the issue. Where possible, raise any concerns with our operatives on site before they leave the property.

We will investigate complaints in good faith and respond within a reasonable time. In the event of a dispute that cannot be resolved directly, you may have rights to pursue the matter through applicable consumer protection channels or the courts.

13. Data Protection and Privacy

We will collect and process personal data, such as your name, contact details, and service information, for the purposes of managing your booking, delivering the Services, and handling payments and queries.

We will handle your personal data in accordance with applicable data protection laws in the United Kingdom. We will not sell your personal data to third parties. We may share your details with service partners where necessary to fulfil the Services or legal obligations.

14. Force Majeure

We will not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure results from events, circumstances, or causes beyond our reasonable control. These may include, but are not limited to, severe weather, accidents, road closures, strikes, civil unrest, or failures of utilities.

Where a force majeure event occurs, we will use reasonable efforts to resume the Services as soon as practicable or agree an alternative date or arrangement with you.

15. Variation of Terms

We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to the Services provided under that booking.

We may also agree specific additional terms in writing for particular jobs or commercial arrangements. In the event of a conflict between these general Terms and any specific written terms, the specific terms will prevail for that job.

16. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the provision of our rubbish removal and waste collection services.

17. Severability

If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms and Conditions, together with any written quotation or booking confirmation issued by us, constitute the entire agreement between you and us in relation to the provision of the Services and supersede all prior discussions, correspondence, and understandings.

By proceeding with a booking or allowing our operatives to commence work, you confirm that you have read, understood, and agree to these Terms and Conditions for rubbish removal and waste collection services.
